When is a gift taxable?
In Germany, gifts are generally subject to tax. Whether you have to pay gift tax depends on:
- the value of the gift,
- your relationship to the person giving the gift (e.g. child, spouse, friend),
- and whether you have received anything from this person in the past ten years.
There are tax-free allowances depending on the relationship:
- €500,000 for spouses
- €400,000 for children
- €20,000 for friends
If the value of the gift exceeds these limits, you may have to pay gift tax.
👉 Good to know: These allowances reset every ten years. After that, you can receive further gifts tax-free up to the respective limit.
Who must report the gift?
Both the person giving the gift and the one receiving it are legally required to inform the tax office. The responsible tax office is the one where the donor lives.
In some cases, the tax office may then request a formal gift tax return.
Can I do that with Taxfix?
☝️ Reporting a gift or submitting a gift tax return is currently not possible with the Taxfix app. This function is not supported at the moment.
